1. Acceptance of Terms
Welcome to HookSpot (the "Service"). By downloading, installing, accessing, or using the HookSpot mobile application, website, or connected APIs, you agree to comply with and be bound by these Terms of Service.
These Terms form a legally binding agreement between you and HookSpot. If you do not agree to these terms, you must immediately cease all use of HookSpot and uninstall the application.
2. Accounts and Authentication
To access most features of HookSpot, you are required to authenticate via one of our supported methods, which include Phone Verification (OTP), Google OAuth, LINE Login, or Facebook Login.
- Account Responsibility: You are solely responsible for all activity occurring under your account and for maintaining the confidentiality of your credentials.
- Data Accuracy: You agree to provide accurate and complete registration profiles. Impersonating other anglers, individuals, or entities is strictly prohibited.
- Termination: HookSpot reserves the right to suspend or terminate accounts that remain inactive for extended periods, or those suspected of fraudulent, duplicate, or malicious registrations.
3. Fishing Spots & Community Content
HookSpot provides interactive mapping, fishing spot registration, reviews, catch records, and media sharing.
- Content Ownership & License: You retain ownership of the photos, reports, and comments you submit. However, by uploading content, you grant HookSpot a perpetual, worldwide, royalty-free, non-exclusive, sublicensable license to host, display, distribute, modify, and utilize this data (including GPS coordinates, photo EXIF metadata, and time data of public fishing spots) within the HookSpot maps and discovery feed.
- Private vs. Public Content: Coordinates marked as private catch records will remain shielded according to your app settings. However, you acknowledge that publishing public spots exposes coordinates to other platform users.
- Moderation & Removal: HookSpot uses automated systems and manual review to moderate content. We reserve the right, without prior notice, to remove or restrict any content that violates community guidelines, local wildlife regulations, copyright laws, or contains offensive materials.
4. Memberships & Billing
We offer standard access as well as premium membership plans ("Pro Memberships") providing enhanced features, elevated maps, unlimited catch logs, and priority weather analytics.
- Billing Processor: All membership payments and subscriptions are processed securely through the Google Play Billing system or App Store In-App Purchases. Payment terms and conditions are dictated by the respective billing handler.
- Subscription Renewals: Pro subscriptions auto-renew at the end of each billing cycle (monthly or annually) unless turned off in your app store subscription manager at least 24 hours before the current period expires.
- Refunds: Refunds are handled exclusively under Google Play / App Store platform policies. HookSpot does not directly manage or issue refunds for subscriptions.
5. User Conduct Guidelines
To protect our angling community, you agree not to engage in the following prohibited behaviors:
- Using automated scraping, bots, or reverse engineering scripts to harvest spot data, tide schedules, or member profiles.
- Submitting misleading, incorrect, or mock location pins that compromise navigation safety.
- Harassing, threatening, or writing defamatory reviews against local spot owners, charters, or other anglers.
- Violating regional fishing seasons, limits, or ecological protection guidelines when coordinating activities via HookSpot.
6. Service Liability Limits
HookSpot provides tide tables, QWeather forecasts, water flow reports, and community coordinates on an "AS-IS" and "AS-AVAILABLE" basis.
- Tide & Weather Forecasts: Meteorological, wind, and tidal predictions are mathematical simulations and may not match real-time marine conditions. You agree not to rely solely on HookSpot for navigation, maritime safety, or high-risk maritime operations.
- Limitation of Liability: Under no circumstances shall HookSpot be liable for any direct, indirect, incidental, or consequential damages arising from physical injury, boat damage, lost equipment, or navigational errors occurring during fishing trips.
7. Updates to the Terms
As our features expand, HookSpot may modify these Terms of Service. When updates occur, the updated document will be published at this web address.
Your continued use of the HookSpot application after the publication of revised terms constitutes your acceptance of the updated terms. If you do not agree, you should stop using the service.
